This Services Agreement is made for the purpose of providing supports under the Participantโ€™s National Disability Insurance Scheme (NDIS) plan.

All Parties agree that this Service Agreement is made in the context of the NDIS, which is a scheme that aims to:

  • support the independence and social and economic participation of people with disability, and
  • enable people with a disability to exercise choice and control in the pursuit of their goals and the planning and delivery of their supports.

SIL and SDA supports

SIL supports are provided as a โ€œProgram of Supportโ€ as defined in the NDIS Price Guide. Under these arrangements we will review your support program every 12 weeks. Should we agree that revisions to your supports are required, these will be implemented. If we agree that no changes are required, the program will continue until the next 12 week review. Please note, that this does not preclude a review being completed at an earlier time should your circumstances change. You can seek to amend a program of supports with two-weeksโ€™ notice.

Board and Lodging for SIL and SDA is NOT charged from NDIS plan. A separate agreement is required.

We agree to provide the Participantโ€™s supports as described in line with the NDIS Price Guide.

The supports and their prices are set out in the NDIS Price Guide and may be accessed on the NDIS website. All prices are GST inclusive (if applicable) and include the cost of providing the supports. If there are any changes to NDIS Price Guide within the period of this Service Agreement the Schedule of Support will not be changed but the new rates will be invoiced.

Additional expenses (i.e. things that are not included as part of a Participantโ€™s NDIS supports) are the responsibility of the Participant/Nominee and are not included in the cost of the supports. Examples include entrance fees, event tickets, meals, motor vehicle expenses etc.

Schedules can be varied at any time upon mutual agreement between Provider and Participant/Nominee.

2. RESPONSIBILITIES OF THE PROVIDER

We agree to:

  • provide supports in a manner consistent with all relevant laws including the National Standard for Disability Services (2013); National Disability Insurance Scheme Act 2013 and rules; United Nations Convention on the Rights of Persons with Disabilities preamble (2006); Australian Privacy Act (1988); Disability Discrimination Act (1992); Equal Opportunity Act (1984) and the Australian Consumer Law; and any other Standard, Regulation or Legislation that apply within South Australia
  • maintain accurate records on the support provided to the Participant
  • protect the Participantโ€™s privacy and confidential information.
  • facilitate regular contact to assess how and when supports are provided and give opportunity to voice any concerns and review the scheduled supports. Also to receive feedback regarding individual staff performance.
  • provide consistent quality staff, at the Participants preferred times, to the best of the organizations ability within the constraints of staffing conditions as per the Social Home Care and Disability Services (2010) Award, the National Employment Standard (2010) and the Fair Work Act (2009). Agency staff will only be used as a last resort
  • comply with safe working practices
  • give the Participant a minimum of 24 hoursโ€™ notice for any changes to schedule if required
  • communicate openly and honestly and in a timely manner
  • always treat the Participant with dignity, courtesy and respect provide the Participant/Nominee information with instructions on managing any complaints or disagreements
  • provide the required notice (60 days) if the Service Agreement needs to be terminated
  • issue regular invoices for the supports delivered to the Participant
  • After hours On Call Services provided (as negotiated)

3. RESPONSIBILITIES OF PARTICIPANT/NOMINEE

The Participant/Nominee agrees to:

  • negotiate with FGCS about how they wish the support to be delivered to meet the Participantโ€™s needs and staff availability
  • communicate openly and honestly in a timely manner
  • always treat all employees with courtesy and respect
  • notify us by making a phone call in cases of sickness, or an unexpected or emergency situation
  • provide a minimum of 24 hoursโ€™ notice in cases of any other requested changes to the schedule (roster). If a number of changes are requested the minimum notice period is 1 week.
  • make payment for โ€œno-showsโ€ or late cancellations of services unless negotiated otherwise (full-service fee is charged for cancellation of less than 24 hour notice)
  • provide the required notice (14 days) if the Service Agreement needs to be terminated.
  • advise us immediately if the Participantโ€™s NDIS plan is suspended or replaced by a new NDIS plan or the Participant stops
  • being a participant in the NDIS
  • assist with providing a safe workplace/environment for our employees whether it be in a home, in a motor vehicle or a public area.

4. PAYMENTS

After provision of satisfactory support services payment will be requested from:

For the purposes of GST legislation, the Parties confirm that:

  • a supply of supports under this Service Agreement is a supply of one or more of the reasonable and necessary supports specified in the statement included, under subsection 33(2) of the National Disability Insurance Scheme Act 2013 (NDIS Act), in the Participantโ€™s NDIS plan currently in effect under section 37 of the NDIS Act;
  • the Participantโ€™s NDIS plan is expected to remain in effect during the period the supports are provided: and
  • the Participant/Nominee will immediately notify the provider if the Participants NDIS Plan is replaced by a new plan or the Participant stops being a participant in the NDIS.

5. CHANGES TO THIS SERVICE AGREEMENT

If any changes to the support provided is required, the changes and options will firstly be discussed. Then if required, a new Schedule of Supports will be provided by us which needs to be accepted, in writing, by the Participant/Nominee.

6. TERMINATION OF THIS SERVICE AGREEMENT

Termination of Service Agreement by either party will be 14 daysโ€™ written notice or as mutually agreed.

7. COMPLAINTS (Please see our complaint and feedback policy )

If the Participant/Nominee is not satisfied with the provision of support and wishes to make a complaint, they can register a formal complaint.

8. PRIVACY AND CONSENT -

The collection and use of personal information is in accordance of our Privacy Policy and South Australian Information Sharing Guidelines. In signing this agreement, you consent to us:

  • Collecting personal information for the primary purpose of providing ILC, including collecting such information from third parties where it is unreasonable or impracticable for us to collect it from the Participant or guardian
  • Saving your personal information on our secure CRM (Client Records Management system), accessible to you and our staff for the purpose of providing services

Using and disclosing personal information for the following purposes:

  • FGCS services
  • Administration and operations such as accounting, risk management, record keeping, statistical analysis, planning systems development, testing, staff training and assessing and monitoring the use and performance via internal and external audits.
  • Other purposes as may be permitted or required under the NDIS Practice Standards
  • For use by our employees, agents and contractors, health providers in your care, financial institutions, payment system operators, persons acting on your behalf, regulatory bodies, law enforcement agencies and government agencies.
